Because eBay is not an authorized apple dealer and a used one can have shrink wrapped slapped on it over the box

I just got a new Iphone 5 from ebay which has no signal so a refurb is not ideal. Old for new.

I got news for u..apple refurbs are better then new. True story. u wont be able to tell the difference. "New" just means they came off of some giant assembly line in china. Refurbed units are given some TLC and the unit is tested and rebuilt cosmetically with all new parts if anything wasn't totally perfect. Be happy. No reason not to be.

And..u may get a new unit after all. But the beauty is that you'll never know.

why the cynicism? do you feel cool being an internet cynic? you're on an internet forum about computers bud, there's no cool around here.

now, why wouldn't an item be brand new if its from ebay? shrink wrapped and unopened is brand new.

As already said, don't be so naive. eBay is not an authorized seller.

Refurbs are remanufactured with new shell and battery. Reused parts include processor, ram, etc.

It was a private seller on ebay seemed to be a unwanted upgrade so I'm tempted not to ask for a refund but just go to the store at Apple and fix it as maybe it was just a faulty batch?

No signal from the moment it was out the box.

Tried restores and resets no joy.

Nobody has been able to help so i put it
Down to either a faulty nano sim or faulty antenna. Going to try and replace the sim first before going to Apple.

Yep, nano sims don't fail too often though. Is it wifi and radio or just radio?

Mine came with a faulty nano sim I've read there have been quite a few that have, but you will get a "no SIM card installed" error message and no sim in the upper left hand corner of the screen
