When recovering from the internet I get the following thing happen http://i.imgur.com/pOg0ssAh.jpg ok so I haven't purchased it, no worries, but which one do I buy?! mountain lion as indicated on the picture etc or lion as indicated in the error? is this just an odd typo?
 
I don't think apple is selling anything but Mavericks at this point.

It doesn't look like it's asking you to buy anything. Looks like it just needs you to input your Apple ID password.

this error happens after you put in your id and it checks your account for the relevant product
 
Well, was your account used to purchase ML or Lion? What OS did your Mac come with originally?
 
How did the machine get ML on it then? It got on there somehow or the recovery partition wouldn't be trying to install it.
 
either put that SL CD in the drive and boot holding shift or make bootable mavericks USB drive and use that?

No.

It hasn't got it on there, it is restoring from the net, when doing that you will download ML. Internet recovery was brought in recently btw.

It does this when there is no recovery partition.
