I wouldnt think the refurbs would have the new update since they are actually older models.

Also, can a refub purchase be returned if its found 'defective' for example dead pixels, or something just doesnt work?

once purchased, a refurb product is just like a normal product
 
If it's the one currently at the apple online refurb store, according to dealmac it has the update software and the tag at apple is "current" ipod touch. But there really isn't anything else too conclusive.

Could the non-updated touch get email, because it is explicitly stated that the refurb can.
 
Oh, thats good to hear, i didnt think it could be returned. i think i will just wait for a 16gb to end up on refurb aftr the price drops.
 
They will more than likely come with the update. All of the older refurb macs come with Leopard. Apple will give it the newest firmware. Don't worry about having to buy the apps.

Yes, but it comes with a limited warranty that is equal in duration and coverage to the warranty offered on an equivalent iPod that is purchased new. And you are eligible to opt in to an AppleCare service plan on equal terms as if you were purchasing a new iPod.

In other words, in Apple's opinion, you can expect a refurbished iPod's performance to be totally unaffected by the fact that it's a refurb instead of a new device.
