Replace second-hand (used) 3gs on apple store??

I m thinking to buy 3gs from someone. If the phone has any problem, can I go to apple store and replace it? Do i need anything or do anything to replace?

If it's still under warranty, has no water damage and has no physical user damage, you may be able to depending on what issue you are basing your exchange on.
