iPod touch reselling iPod Touch on Ebay; will new buyer be entitled to warranty?

I got a free Touch through the student rebate. I know I'm not supposed to but... if I sell it on Ebay, will the buyer be entitled to the one year warranty? I've never registered the Touch. However, on the user agreement, it says something about the 1 year warranty only applying to the 'original end-user purchaser.' I guess I sort of answered my own question but...

Does Apple actually check or enforce this?
Do they keep track of the serial number and the original buyer (i.e., me)?

The Warranty transfers with the item, not the person.

You have nothing to worry about. That's more legal speak than anything else.
