Restocking and Upgrade Question

I purchased a 17'' 2.8Ghz MBP from a reseller about 3 weeks ago. I called my local Apple Store and they said they are indeed honoring the 1-month pay-the-restocking-fee and you can upgrade policy. I said that I bought it online and they said I could almost definitely still do it. My question is, am I disqualified since I bought the laptop from a reseller and not from Apple directly?
