I got a phone from ebay that was on 3.1.2. It had a bunch of apps and songs on it and it was even jailbroken but it did not have SHSH saved. I checked and saw it was old bootrom so I thought I could restore it with a custom 4.1 ipsw to preserve the 05.11.07 baseband. I put it into pwned DFU mode and used tinyumbrella to start a TSS server. It goes through the restore process and then goes back to DFU mode after the loading bar fully loads. I can't use tinyumbrella to kick it out of this state. Will I have to restore to stock 4.2.1?

You need 4.1 SHSH files saved if you wish to restore to 4.1. Since you don't, you will have to go to 4.2.1, but since you have a old bootrom 3GS, it will be untethered. Do everything the same except use a custom 4.2.1 firmware file (one that keeps your current baseband).
