In the past, I've either sold my phone early or given it to family so it's never been a concern.

I still have a 4S that I'll be looking to sell in the coming week or so, but, with iOS 7 now released, would restoring as new force the upgrade from 6, or would I be able to choose which iOS is installed?

It restores to the most up-to-date and compatible version that your phone supports (iOS 7 for 4S, iOS 6.1.3 for 3GS, etc)
