Restore wont erase present files??

I picked up a MacBook Unibody 2.0GHz on craigslist last night.. I went to restore it and I came back at the end of the restore and it said it needed to restart like usaual. This made it seem like it had completed but when it booted up I couldnt put my info and still had his User Account.. So I tried to restore again remembering that I normally had to go to "Erase and Archive" so I started the restore again and I didnt get this choice and it did the same thing.. Is there a setting in System pref to change this or what?? Can someone help me??
