Ring not Entering Silent Mode

The toggle switched to no color should have the ring set to silent (but vibrate if that's selected). Toggled so that the red is selected should have the ring audible (and vibrate if that is selected). But toggled either way, my phone still audibly rings.

Any help?

Same problem (after jb)

Jailbroke my phone yesterday and the same thing is happening to mine since (3gs running 4.0.1). Was about to restore in the hope that it will fix the problem, but wanted to do a little research first. Any suggestions?
