iPod touch scratches question

Ok, I am clearly aware that the scratch on my iPod must have been my fault considering the scratch wasn't there when I opened it. Now, my iPod is under a 30-day return policy and I was wondering if you think that the scratch will void the policy or if I can get a new one?

I've read on people exchanging their itouches over the scratch a few times, so i guess it's returnable.
