alright so my macbook is sitting under the tree and i was wondering since i just got it sunday if their are any problems still with the harddrives? and as soon as i open it i am going to be dumping 40gb of data on it will this bother anything or should i "break it in" slowly doing a little each day for the first week?

I think Apple finally ran out of Seagate 7.01s, so, barring any new killer drives, there shouldn't be an increased risk of failure. You can check to make sure you don't have it by going to 'about this mac'->'more info'->'sata'. The rate of data addition shouldn't make a difference; the drive should "just work".
