I am about to buy an iPhone 2G locally today. The seller told me it was a warranty replacement he got on November 6th but is not going to use because he upgraded to 3G at the same time. He is saying that it has 60 days of warranty left.

1-Do warranty replacements come with a 90 day warranty? I just read that the warranty applies 90 days from the date of replacement in an Apple document.

2-Will this warranty period transfer to a new owner (me) like Apple Care normally does?

3-He is saying that it is brand new and I have no doubt it appears that way to him, but is this actually new or a refurbished unit?

I'm going to see it this afternoon so any replies before then would be very appreciated.
