iPod touch Shuffle disabling?

My iPod Touch, (32GB 1st Gen, OS v3.1.2 - jailbroken) plays on shuffle fine. Until I pause a track and go use an app and come back to continue the song, then shuffle is off and it plays the songs in alphabetical order by song title.
I don't notice this until it plays the same song twice. (eg. studio version then live version) Anyone else experiencing this?
