Smart case locking ipad when it shouldn't

Hi,

Since updating my mum's iPad air 1 to iOS 9 for her this problem has arisen.... if she opens the smart cover and rests it on the back of the ipPad it's fine, until the final smaller panel hits the back of the iPad. As soon as this touches then the iPad locks as if the cover has been put on the front of the iPad.

Has anyone seen this before? Does anyone have a solution?
