iPod Smart playlists on iTunes/iPhone not matching up

The recently added in my iTunes library is not matching the one on my iPhone. I want the one on my phone to be exactly like the iTunes one, but they are completely different. Even as I add songs to iTunes, the smart playlist on the iPhone is off. This is the case for almost all my smart playlists.

They were matching up but my phone had to be restored and they have been wrong since then.

I think iTunes 9 broke them I could wrong but Andy Inathko spoke about this very thing on MBW a couple weeks back and I got frustrated with the issue that I created a new set of playlists just for syncing them to the ipod touch. Smart playlist with rule playlist is .... (insert you playlist).
It is stupid but I manage my podcasts this way was really annoyed by these disfunctional smart playlists

anybody have any ideas to fix this?

I have tried re resrtoring the phone, but nothing. the playlist is correct on my computer. This basically makes my iPod not functional for me because I stayed in those two playlists..

The other thread brought the solution it works like a charme.

Playlist - is - Music worked!!! should be added to your playlist criteria
