iPod touch Some (many) apps won't transfer to new Touch

I just picked up a new G4 to replace my old G1. I essentially want to mirror it with the old one. Unfortunately many of the apps are grayed out on the iTunes Apps tab (with the little 'A' for app in the middle of each icon). I can put checks in the boxes but they don't sync like the 'colored' apps do. There does not seem to be any real consistent quality about them. Most are free- although Slingbox was not. Is there some sort of sync or authorization I need to do?

I'm syncing these successfully onto my iPad, iPhone and old G1 touch.

Any ideas?
