iPod touch Songs that won't play

Ok, so I would notice that every once in awhile a song from an album would simply not play. The song would start up, play silence for about 4 or 5 seconds, then continue on to the next album song. I have 1245 songs (16gb non-jailbroken touch with Jan. upgrade), and I kept a list of the songs and there are about 42 songs that are like this (3% of my touch library). Most of the songs are from albums that I burned onto my friends computer and then to my Creative Zen and then from my Creative Zen to my touch when I got it.

Have you tried a restore?

Could also try and download one of the songs, see if it's the individual file or something else.
