Spacing issue in Finder (when maximalized)

Even on prior Public betas I had the following issue. I'm on Public beta 8 20A5374i now and it's still not fixed

When I maximize (fullscreen) a window the sidebar has spacing issues and I can't see the top as the menu bar hovers over it.

See attached screenshot where for example fullscreen the top 'recent' is gone.

Anyone else has this issue?
