I got a spotlight file under preference panes in the system folder but no actually settings file. The last time I deleted it(when I tried to fix this same problem) it apparently didnt recreate itself.

We were seeing this problem on a few older machines. In each case, we found that someone had tried to put Front Row on them. Removing Front Row.app from /System/Library/CoreServices, then having the user log out and back in, restored the Spotlight menu to working order.

I had this issue occasionally, which was fixed by switching to and from another screen resolution.

There have been allot of people with that same problem. Mostly because they tried to install front row.
Maybe there should be a sticky about this.
