Stacks - I have no 'Fan' view!

I'm really not sure if this is some stupid thing I'm missing, but I've never been able to choose 'Fan' view for any of my stacks, I only have List or Grid!
I've tried it for all different sized folders, and I can't think why it's not there... any suggestions?

When the dock is on the left or right of the screen Fan view is not allowed.

if you think about it fan view wouldnt work on a vertical dock as the filenames wold have to be vertical too… that and it would also look like a cock

I'm re-visiting this issue simply because I'm wondering how to work around this, if it's possible. Perhaps there is a terminal command that could force-enable the fan option while the dock is positioned on the left/right?

As ugly as it might be, I really liked having it
