I had the same problem recently with a random file I found the following on apple support forums
Open terminal and type
sudo rm -rf
press the space bar. do not press enter yet. next drag one of the problematic files from trash to the terminal window.
you should see something like this
sudo rm -rf path/to/file
Press enter. You'll have to enter your admin password (which you won't see). That's normal. This should delete the file in question.
yeah i tried this but also didn't work dude....
get this on terminal :

Or you could just open terminal and type:
rm -rf ~/.Trash/*
If that doesn't get rid of it it might be on another drive, then you might have to use the command suggested above.
also didn't work... i don't hav any other drives at all, only my iphone, but i don't use it as external drive... this is driving me crazy, thinking on formating...
