Subtitled files from Submerge not syncing to Apply TV?

I create my file using VisualHub which creates a working and playable .mov file, I then add the subtitles using Submerge. It creates a working file that plays in iTunes and in Quicktime but will not sync to the Apple TV. I have been able to reproduce this 3 times. So I'm guessing its something that Submerge does to the file. Anyone have this issue?

And yes I know I should use Handbrake for the subtitles but its always crashing on me.
