Luxpro Technology said it has decided to file a 100 mln usd compensation lawsuit against Apple Computer Co Inc for losses incurred from the US firm's provisional disposition action motion involving Luxpro's MP3 players.
Apple in 2005 filed a provisional disposition action motion against Luxpro's Super Tangent, the Top Tangent and the EZ Tangent MP3 players, the Taiwanese firm said in a statement.
The US firm claimed that the rectangular case and round control buttons on the case cover of the products closely resembled Apple's iPod Shuffle.
Taiwan's Shihlin District court issued in August 2005 an execution order demanding that Luxpro desist from manufacturing, selling and advertising such products.
But Luxpro in November 2005 won a High Court appeal on the case. The Supreme Court in March 2006 upheld the High Court's verdict, in favor of Luxpro.
The Shihlin District Court then declared in December 2006 that 'the appearances of the two products are significantly dissimilar,' overruling Apple Computer's claim and issuing a case verdict in favor of Luxpro, according to the Taiwanese firm's statement.
