For all those people who never look up from their phones this is a good time to learn a lesson before you too fall into a man hole!
 
Someone needs to slap that girl twice. It's no one's fault but hers, yet from her remarks you'd think it's everyone else's fault except hers, from the maintenance guys to whomever it was who invented texting. I mean seriously, how hard is it to watch where you're walking? If she really knows the area as well as she claims, then she would know there are manhole covers about, and it stands to anyone with an IQ above a bell pepper that manhole covers might be open from time to time.

No. In this case, the city's negligence far exceeded the girl's.

The girl had a reasonable expectation of walking without falling into an open manhole.

Honestly, I hope this teaches idiots to loosen up on their phone fixations.
 
The city was definitely negligent, but after going for a walk this evening (with this story in mind) and noticing the manhole covers from time to time - you'd have to be pretty oblivious to everything around you to not notice a missing cover.

Next time anyone is out walking around, pay attention to the manholes and you'll see what I mean. :D
 
The DEP is at fault for failing to secure the area around the manhole.

But that girl should feel pretty stupid for not paying attention. Suppose she was texting and walked into a moving car and got killed like that girl in Toronto last winter? A lawsuit won't bring people back from the dead.
 
I think there is negligence on both of the workers and the teenager. But you really shouldn't walk without watching where you are going, lest you fall into an open manhole.
 
Humankind is on a slippery slope to extinction if people fall down holes and blame others for it. She should look where she's walking.

People can't expect to be wrapped in cotton wool all their lives.

but i think it was more the girl's fault. i mean. she should always be aware of her surrounds and stop texting so much. she could've avoided that manhole

Most cities have them in the middle of the road as you state. Some have them on the street but towards the curb. But I've rarely seen them in the middle of a sidewalk.

In my city, yes most are in the street but allot are also in the middle of sidewalks and especially on corners where storm drains are. I think this was the same way where she was.
 
If she didn't see the OPEN MAN HOLE, then why would she have seen cones etc.

She learnt her lesson - I hope.

She's lucky she didn't get run over. That would have been Darwin Award winning.
