i think i did the neccessary steps as far backing up my iphone 4 goes.

here's what i did.
i synced my iphone 4 and backed it up before syncing my iphone 5.
but Tether app is nowhere to be found on my iphone 5. its still on my old iphone 4 though, is there a way to transfer it manually?

my phone is not jailbroken, the iphone 4 and iphone 5.
 
I believe if you backup using iCloud, it won't recover apps that are no longer sold in the app store.

If you have the app saved to iTunes on your computer (or transfer it from the old iPhone to iTunes,) you should be able to use iTunes to put it on your new phone. At least, that in theory should work.....

i have it saved on my itunes library via apps.

i tired dragging the app form my itunes apps library to the iphone 5 but it didnt work.

or do i have to go to devices>iphone 5>apps

then check the sync apps? when i do it gives me this warning box "Are you sure you want to sync apps? All existing apps and their data on the iPhone “Bry's iPhone” will be replaced with apps from this iTunes library."

should i just go ahead and check sync apps?

I restored via iCloud and Tether came over just fine...
 
I had a tethering app too, and it didn't at first download to my iPhone. My solution is as follows:

Plug in your iPhone into your computer and let it sync.
Go to the apps page, and UNCHECK the tethering app (on my itunes it said the app was on my iPhone although it wasn't). Let the phone sync.
Once that sync is done, RECHECK the app and hit apply and viola!
 
That's very odd, Tether downloaded to my new iPhone 5 with no problem, and I've restored both of my 4S units with no issues either.

I seem to be having an issue getting the old Tether app to work with Windows these days, but that's another story. :D
