The eBay maddness start with 3G iPhones

Looks like people are starting to put up their newly acquired iPhone 3G's onto eBay already..

So I have 2 questions...

1. if I brought one and got it unlock etc.. and popped in my O2 PAYG sim card would I have access to the 3G network when surfing or would I be stuck with GPRS/EDGE

2. I thought that the only way would walk out of O2 or CPW with one would be to sign the contract and have it all activated and stuff in store. is this not the case?
