Hello,
I have bought OtterBox Defender for my iPhone 4S from a seller called "gadgettown" in eBay.
Before 2 Days I have noticed that the case is fake and now Im wondering what to do.
I talked with the seller and he offer me to get 20% off from the item value or to return the case and get full refund.
because Im live in Israel and the case sent from the US it will take some time untill I'll get the money back and buying new case from another seller.
I have 4 pictures of the case:

The case feels very good and the silicon is pretty hard.

so what do you say - keep the case and request discount from the item value or send it back immediate?

thanks.

I searched in eBay and did not find any seller that sell ORIGINAL OtterBox Defender case with normal shipping price (to Israel). that's why I don't know what to do becuase If I'll send back the case to the seller I will not find another seller for original otterbox products.
I enter to the official site of Otterbox and buying from them is too exspnsive. Mainly shipping price (28$) so that is not an option for me.

:confused::confused::confused:

Other than keeping an eye on Amazon for some good sales, I don't know what else to suggest other than :

If the seller said it was a real Otterbox case, you could dispute it with ebay/paypal. In those cases, IIRC, they generally just ask proof of destruction of the case before issuing a refund.

Go to here and see yourself - http://www.ebay.com/itm/370656568281?ssPageName=STRK:MEWNX:IT&_trksid=p3984.m1439.l2649

Only if you go to "contact member" and click on "Details about item" you can see that the seller wrote
Is the item original?
gadgettown : This item is not original, it is 100% new guarantee on quality.

It is very TRICKY and he need to mention thats in the title or in the item description.

There is a thread on here about a real otterbox damaging (staining) an ip5. Otterbox will more than likely replace the owners phone. Will your eBay seller??

I can't send the item back because the shipping cost it too much high (20$) from IL to USA.
I told this to the seller and he suggest 30% off from the item value. This way he will return to me 10$.
It would be rude if I ask 40% ?
thnks.

Just curious, what makes you think it's fake? The seller seems pretty legit. Good feedback rating. No negative feedback about fake merchandise. Did they admit it is fake? If you have the seller's admission to selling fake cases I would demand they pay the return shipping.

The seller wrote thats its not original but he didnt wrote that in the title or in the item description so i couldnt know from the beggining thats is fake.

Im pretty sure that he will not pay the shipping cost (20$ from israel to usa with tracking number).
I dont have any option... I'll take the 30%.

I read a little about the ebay buyer protection and in situasion like me eBay request to send back the product to the seller and like i said its too exspensive.

If the item has the otterbox name brand/logo on, you can file a claim with Ebay and paypal for counterfeiting. The seller probably get a warning if this is the first time, if not he will get banned.

I looked at the auction and he doesn't claim it to be fake but by using the pictures and the name he is telling you this is what it is; an Otterbox Defender. He doesn't need to call it genuine because he's absolutely implying it's real with all other information. You said he told you it was fake? Where did he write this? You need to take screen shots of the auction page and tell him that you want a refund and you'll ship it back but he needs to pay shipping. You also need to tell him if he doesn't do this you'll file a claim because he sold counterfeit goods.

My issue with the pictures and your thread title is you suggest you know the difference between real and fake Otterbox cases. How do you know this? Your pictures don't really explain. I'm not sure it is even a fake short of you saying you were told somewhere it was a fake.

If this is indeed a fake and the seller told you that then you should not waste a single penny on getting a refund.

OP, I am really confused. I could not find where it said it was fake. It looks totally legit down to him using the Brand Name and Case Name. If this is fake you should file a dispute with ebay as he sold you a fake product claiming it was real. I agree with above that you should take a screen shot of the listing because there is nothing there that says it is fake, I would assume it is real.

I did not understand where he told you otherwise.

You go to "gadgettown" -> "contact member" -> and now look at the screenshot:

So I talked with the seller and we reached an agreement. He refunded 35% of the item value.
Unfortunately, only now I read your comments and I suppose that there's nothing to do but I hope that will help to future buyers in eBay.

I would still contact ebay as it is a violation of copyrighting for Otterbox in what he is doing.
