Someone made the point that the iPod touch 1.1.3 upgrade is akin to shipping a mac with Tiger and then when Leopard ships, selling it with that. The early user still has to pay to upgrade to the new OS and the new user gets it free. This point was made to demonstrate "piracy" issues, which i find erroneous in this case, since its just a 0.0.1 update.
However, as the iPod touch and iPhone software develops, eventually Apple are going to have to market the mobile OS in the same way that they market its bigger brother OS X. iPods used to run in their own little software worlds, which were not interchangeable, but with the advent of the touch based OS , many products can run a single (though modified) OS.
Eventually Apple will release a significant update to the iPod and iPhone, and the user will eventually have to accept that maybe iPod touch and iPhone Generation 1, wont be able to run the latest iPod/iPhone OS.
So although the debacle about 1.1.3 payments seems unfair now, future significant updates (note, 1.1.3 surely was not significant enough to warrant a payment?) may be branded as New OS releases, just like the bigger cat.
