One of the things that made me do the switch to Mac OS, was the magic mouse, its touch sensitive scrolling is a unique interaction with the computer.

Now, windows has touch mouses too. Does apple get some cash from such sales, doesnt apple own a patent on this?

Apple does own patents on touch devices... but they're mostly for multi-touch, which may or may not impact Microsoft's mice. I'm interested in this topic myself. :)
