I have an iPod touch (3rd gen) and an iPhone 3GS and I have paid apps on my iPod touch, I as wondering if there is a way to transfer the apps via iTunes to my iPhone 3GS?

Just plug your iPod into iTunes and click Sync. Then do the same for your iPhone. They should all transfer over. Note: The apps' settings will not transfer this way.

I've tried this it didn't work.

With your iPod plugged into iTunes. Right click it's icon in the left column. In the menu that appears select Transfer Purchases. When it is done, plug in your iPhone and go to it's Apps tab. Check, Sync All Apps or you can check the apps you want to sync. Then click Apply/Sync.

Ok I'll try that thanks.
