Hi, I am trying to restore to a MBP from a time machine backup taken from an old MacBook but it is telling me 'the software the time machine was on, was too old'. Does anybody know how I get around this ?

The older Time Machine is probably unsupported because it's too old.

Your best bet is to manually transfer files via flash drive (the important ones that you need).
 
Or use migration assistant. I recommend not doing a TM restore regardless if it worked, especially to a new HDD/SDD. I recommend clean install and manual transfer.
 
Yes use ma , if that does not work you can switch ur old user folder manually from external drive to your new MacBook without even using ma. This will also make it look like clone from your old MacBook.
