Unknown Files Keep Showing Up ( __00 )

hay,

i'm setting up my NAS (ICY BOX 2 Bay IB-NAS3221) and finally got my shares all sorted out. but when i've been copying files over osx / smb is returning read write errors and when i try clean up after i can't delete the dir because of this file __00 which when deleted reappears ?

can any one help with this ? i've attached a screen shot of the dir in question

Also....

i have also found a app called newsfire which when i try delete it, it comes up with "sparkle.framework is in use" but further investigation has turned up that the sparkle framework folder has a file called headers in it which when deleted readds its self. picture included below.
