unlock without jailbreaking?

hey all, two questions:

1: can you unlock the iphone without jailbreaking? i want to use an iphone on my at&t plan but do not want to pay for data.

2: once 2.0 is out, if the first option is possible, will i be able to use the 2.0 firmware/appstore while in wifi range but keep my unlocked iphone?

yes you can you can just unlock it

and once the 2.0 is unlocked you'll be able to upgrade with out having to sign up for a contract and i don't see why you wouldn't be able to use the app store
