Thinking about getting the wife a new IPhone since the price drop but the 2 year contract bugs me a lot. So, let's say I buy it now and sometime next year a new killer IPhone comes out (3G/GPS/32GB . .don't argue this point). Can I simple buy a new one, swap the SIM cards and use the new one without modifying my service contract? If so, could I then just sell the old phone with the new (and unactivated) SIM card?

Absolutely!

Since you can pick up any iphone from the apple store without signing up for service first all you have to do is pop your old sim in and your off! Since you already have the data plan from your old iphone you wont have to worry about a thing. Packup the old iphone with the new sim card and sell it on ebay to offset the cost of the new phone.
