im not eligible to upgrade but my wife is. She doesn't want the new phone but I do. If she buys the new phone at the upgrade price can I activate it as my phone?
 
just get it for her, then switch SIMs

IF i upgrade my mom's phone from flip to smart phone i will have to pick a data plan, so when i put my sim into the new iphone, won't i have to call att and tell them her phone actually isn't an iphone and take off data? also switching sim's won't effect my unlimited will it.

If you have At&T you can just take her upgrade price from her on the AT&T website.

I should be able to just pre order it through att on Apple's website, right? It won't come activated. So I plug in her info for pre-order and then activate it with my info once it arrives. That should work, right?

I don't see why that wouldn't work.

I'm not sure how it works if you're not on a family plan. Use AT&T's online chat and ask them. They're pretty helpful.
