I need to do an upgrade swap with a line that isn't a smartphone. If I go through the ordering process online with the Apple store, it asks me to choose a data plan. Once I receive the phone, can I just take it to the AT&T store and have them do the swap and not have the data portion added to the non-smartphone line?

Yes, i think what will happen is as soon as you put the sim back in the non smartphone you will have to call and have the data package removed. You may still have a small prorated amount for the data plan though.
