Upgrading Jailbreak from 4.0.1 on iPhone 3GS?

I need to upgrade my phone from iOS 4.0.1 to a higher OS. My question is what's the minimum I can upgrade to to be able to use my phone as a personal wifi hotspot for my iPad 2?

I have the AT&T unlimited data grandfathered plan.

You can upgrade to the newest 4.3.3 and still be able to use your hotspot features.

I heard some people were losing the ability to use it. Is that not true? I don't have the new AT&T data plan but the old one. Pls let me know. Thanks!
