upgrading painlessly from 3.1.2 to 3.1.3?

Hello I have a ipt 3rd gen that is jailbroken with blackrain on 3.1.2
I want to know if there's an easy way to upgrade the firmware but still keep all my jailbroken apps and data. i know that you can restore and then use the spirit jailbreak, but then my apps will be gone won't they?

yeah, with the update it'll restore your device then upgrade the firmware. i think you as long as you have the apps in your itunes you should be able to transfer them back into your ipod touch, but you probably won't have your data for your games.

Isnt there a way to get the 3.1 firmware for free someplace yet?

I think it is BS that Apple wants to make us pay for it when i shelled out $400 for this thing and then had to pay for the apps it didnt come with on my first gen when it came out and then later on gave them away for free....but i still had to pay for them! Im sure 4.0 will cost $10 as well so id like to get the 3.1 for free if i can.
