Upgrading to iPhone 4S from factory sealed box

Hey all. So I recently ordered an iPhone 4S from eBay factory sealed. When I just tried to upgrade the phone with Verizon service the phone automatically took on a phone number which I presume is the number of the original account holder (as when I upgraded to an iPhone it automatically took on my account information). The original owner obviously bought the upgrade for $200 then sold the upgraded phone on eBay. My question is how do I switch the number so the phone doesn't "think" it's still the original account owners phone?

Take it to Verizon.

Call them first and give them your MEID number to check if its clean (not stolen). I know you got it sealed but its strange original owner didn't deactivated it first.

Is there anything I should say or not say when I go to Verizon? Anything illegal about what I did?
