Use old iphone 3g as a phone without a data plan?

Thinking about giving my little bro my old iphone 3g when I get a iphone4.

Just wondering if my bro can just slide his sim card into the iphone 3g and work fine without a data plan? It's not jb and we are on a At&T plan.

The reason I ask is that on AT&T site it says it might charge you for data if you don't have one.

So has anyone done something what I'm doing before?
