So, I just bought an iPod Touch last week (4th gen, 64 gb) from ebay.
It was purchased by previous owner in August this year, worked great when I first got it.

The last two days, it's been annoying. For some reason, it keeps switching out to Voice Activation mode during songs, and sometimes fast-forwards the song, or pauses it, and I have to either replay the entire song or skip it.

I tried resetting just the settings to fix the issue; didn't help.
I tried, today, resetting the whole iPod. Still experienced the same problem.

So, what can I do? I can probably contact the seller or something to check on the warranty, but is there a simpler solution?
 
Anyone have any ideas?
It still glitches, even after I turn it off and on again.

Maybe it's the new iOS?
