Don't know if this has been discussed before, but I've search for the topic before I post it, sorry if this is re-posted.

This question came in my mind from the previous swap SIM cards question many people are asking.
From what I understand, the owner of the line must activate the phone from his/her number first before he/she can swap the SIM card with another.

On the ebay, you can see many sellers are pre-selling the never opened 3GS, what will happen to the seller if he/she never activated the iPhone before sell it? Will AT&T or Apple asks for the phone back since in the record, the phone has never been activated from his/her number?

And what will happen to the buyer if he/she activates the iPhone through his/her existing contract with AT&T? Will it automatically extend the contract to 2 more years?
