I ordered an iphone 5 friday the 12th of april. But what iOS is most likely to be running on it when I receive it? Is there any chance it is NOT ios 6.1.3?

There is little to no chance they come with anything earlier. I just purchased one last week, and tried to do an update and it claimed it was already up to date: 6.1.3. They always load the most recent version coming from the factory.

..

well, goodbye jailbreak it seems.. Gotta hope the phone has been boxed a couple of weeks ago just before iOS 6.1.3 got released. But I doubt I'm that lucky..

Do you know why this would be? I couldn't think of any valid reason why it would come with obsolete software brand new from Apple.

i'm guessing they started production of these new tmobile tweaked iphones before ios 6.1.3 came out. probably started producing them when 6.1.2 was out

I just bought an iPhone 5 yesterday at the at&t store and it was running 6.1.2 ... when I got home, I had to update to 6.1.3. My guess is that it is going to come running on 6.1.2.

Based on the reports from users, it appears about 3/4 of the phones have come with 6.1.2. Expect that to change over the coming weeks since it appears they already shipped some with 6.1.3. If you want 6.1.2 you better hurry.

returning to apple?

IF I'm unlucky and get an i5 with preinstalled ios 6.1.3, will I be able to return it to apple? I bought in from the apple online store. But i'm not quite sure if I can check the iOS and then return it if it is on 6.1.3?

Online orders are not eligible to be returned to a physical Apple Store.. you could try your luck returning it (within 30 days) via their Online Return system, and then turn around and purchase another one and *hope* that the next one comes with 6.1.2.... but you aren't going to be able to just exchange it at will at a store on the grounds that it doesn't have a Jailbreakable version of iOS..

I'm aware not being able to jailbreak is not a legit reason to get a replacement. (Would be nice if it was though :) ) So.. I've just cancelled my order at apple (Haven't yet received it yet), and placed an order at a teleprovider in my country. My guess is that the iphone has been in stock at the teleprovider longer than the one I ordered directly from apple. Well, one can only hope..
