Sure your brother's not angry about something (the only reason I can think of for refusing an iphone!).

Surely you have to pay the contract each month for 18 months, since you can't cancel the contract without giving the phone back.

Since he bought it for someone who wasn't there I'm suspecting he bought himself one too, and put these on a family plan. The whole plan won't be going away, just that one phone, so contract doesn't really matter for the phone he's getting rid of.
