Recently when I right-click the desktop using my wireless mighty mouse, the Finder relaunches. This is really annoying since whatever I have in my dock unminimizes.

I also have Shapeshifter installed and sometimes when finder relaunches, it switches back to the default Aqua theme, instead of the theme I have, meaning that I have to go into System Pref and relaunch finder from within Shapeshifter.

What's the problem that I have here? And how can I fix it?

Determine what's causing the finder to restart when you right click? Uninstall Shapeshifter? Use a different theme? ShapeShifter's screwed up OS X for me before (Spotlight), so...
 
Please search for the finder crash log and post the text here. Just look up "finder crash" in spotlight. It'll help tell you what is crashing.

Do you have StuffIt Deluxe installed? If you do, install this update.

What do you have in /Library/Contextual Menu Items/ ?
