I am a apple developer. When I go to the download section of the developer program I don't see a download link for it but I keep reading everyone saying they downloaded and installed it.
 
1) There is no such thing as "apple developer". Are you an iOS developer or Mac developer. You must be in the iOS program

2) Are you a paid-up developer. Betas are not available to free accounts

If you are a paid-up iOS developer you just need to log in and click on the Beta SDK link on the left under the main iOS banner
 
I am a paid IOS Developer.

You're probably looking under iOS SDK 4.3...

As Robbie says, in the Dev Center, do you see the iOS SDK Beta button on top left? When you click this, you should then see the Downloads link which enables you to download iOS 5 for the various platforms.
