Why don't apps recognize when the silent switch is on?

I was playing around with my phone today with the silent switch on. I started installer and it found an update, but it played the little "I found an update!" noise even though the phone was on silent. Why and how do I fix this?

I too noticed this within the last few days and shot off an email to the Installer.app developers... hopefully they can noodle something out.
