Unless I've really over-looked it somewhere, why hasn't this happened? Prevent a thief from shutting it down (when it's being tracked for example).

That won't happen because all a thief would have to do is let the phone die on its own.
You can however have the phone automatically send its location data to Apple when the battery gets critically low.
