I am using an iPhone 3G with ATT's "Data Unlimited" package. The iPhone was purchased abroad (unsubsidized) fully unlocked.

I just received a text message from ATT announcing the 3.0 update. The message ends with the ominous statement: "If you download the software and are not on an approved iPhone data plan, your data service will be interrupted".

The "Data Unlimited" package was recommended by an ATT store when I arrived in the U.S. with my foreign iPhone. Why should I not be able to continue it?

Is it legal/practical for ATT to discontinue my data service?
